Associate Solicitor, Holiday Claims
Yes, although as Holiday Claims Solicitors, we’d always recommend to anyone going on holiday that you take out travel insurance before setting off.
You can probably still submit a claim for compensation for “uninsured losses” sustained as a result of an accident abroad. The claim would be made against the person/s or business who is considered liable (at fault) for your accident and injuries, or against their own insurer (if there is one).
Although travel insurance isn’t essential if you want to claim compensation, the benefits of having cover in place are priceless if you have an accident, fall ill or if your holiday is cancelled due to unforeseen circumstances.
Travel insurance will often also include Legal Expenses Insurance (LEI) cover to help with any subsequent legal dispute arising from the holiday. So we’d strongly urge you to take out a travel insurance policy ahead of any trip, regardless of whether you’re taking a holiday overseas or in the UK.
Travel insurance should cover both you and everyone in your party, and can be tailored to your particular trip. Alternatively, it can take the form of annual insurance, which is often available as an optional extra to home insurance policies or enhanced bank accounts.
We understand that there are many factors involved in arranging a holiday, as well as the sheer excitement and anticipation that comes with going away. So tasks such as taking out travel insurance can easily be overlooked, or even intentionally disregarded as an additional expense that you’re unlikely to need.
But we don’t live in a perfect world, and things can and do go wrong on holiday, such as holiday accidents that leave holidaymakers with long-term and sometimes permanent injuries. So don’t ignore travel insurance, as it can be more than worth the expense if the worst does happen.
