Can I Claim Compensation for a Holiday Accident if I Wasn't Insured?

Yes, although as Holiday Claims Solicitors, we’d always recommend to anyone going on holiday that you take out travel insurance before setting off.

You can probably still submit a claim for compensation for “uninsured losses” sustained as a result of an accident abroad. The claim would be made against the person/s or business who is considered liable (at fault) for your accident and injuries, or against their own insurer (if there is one).

Uninsured losses include compensation for:

  • Pain and suffering
  • Financial costs incurred during the holiday, such as medical treatment and accommodation costs
  • Losses incurred afterwards (such as a loss of earnings if you’ve been unable to work because of your injury)

The likelihood of recovering any compensation, the amount of compensation that can be claimed, and the process involved will vary depending on the facts of each individual case. But in theory, not having any travel insurance doesn’t mean that you can’t claim compensation from someone else’s insurer.

No Win, No Fee

Even if you didn’t have travel insurance for your holiday, following your return home, we can still advise and represent you on a No Win, No Fee basis in holiday accident claims that can be brought in England and Wales.

That means that if we take on your case, there are no fees to pay upfront for our services, and we only receive payment if your claim is successful. So if your claim is successful, you would never pay more than 25% of your compensation for our fees; and if your claim is unsuccessful, you have nothing to pay at all.

So what have you got to lose? If you have fallen ill or been injured in an accident on holiday, and didn’t have travel insurance in place, give our expert Holiday Accident Claims Solicitors a call and we’ll be happy to discuss your circumstances with you, with no obligation to you.

Why Do I Need Travel Insurance?

Although travel insurance isn’t essential if you want to claim compensation, the benefits of having cover in place are priceless if you have an accident, fall ill or if your holiday is cancelled due to unforeseen circumstances.

Travel insurance will often also include Legal Expenses Insurance (LEI) cover to help with any subsequent legal dispute arising from the holiday. So we’d strongly urge you to take out a travel insurance policy ahead of any trip, regardless of whether you’re taking a holiday overseas or in the UK.

Travel insurance should cover both you and everyone in your party, and can be tailored to your particular trip. Alternatively, it can take the form of annual insurance, which is often available as an optional extra to home insurance policies or enhanced bank accounts.

We understand that there are many factors involved in arranging a holiday, as well as the sheer excitement and anticipation that comes with going away. So tasks such as taking out travel insurance can easily be overlooked, or even intentionally disregarded as an additional expense that you’re unlikely to need.

But we don’t live in a perfect world, and things can and do go wrong on holiday, such as holiday accidents that leave holidaymakers with long-term and sometimes permanent injuries. So don’t ignore travel insurance, as it can be more than worth the expense if the worst does happen.
