API Laminates Staff Prepare Legal Action against Failed Firm

A number of ex-API Laminate employees who lost their jobs when the company went into administration are set to take legal action by making Protective Award Claims for up to 90 days’ pay.
Having employed over 100 people, the specialist manufacturer and retailer of foil and laminates based in Cheshire has recently appointed Colin Dempster and Hunter Kelly as joint administrators to API Laminates.
The news left around 67 employees redundant across the company’s factory in Poynton after the company experienced difficulties in recent times.
Further to the announcement, national law firm Simpson Millar say its’ Employment Lawyers have since received numerous calls from affected API Laminate employees to date with more coming through daily and has begun investigations to enable appropriate legal action to be brought in order to secure a Protective Award on their behalf for the company’s failure to properly consult staff regarding the mass redundancies.
Ellis Kindred, an Employment Paralegal at Simpson Millar said, “This is, undoubtedly, an incredibly difficult time for those affected and many will be attempting to understand the news and plan their next steps.
“To date, we have been contacted by multiple former employees, including Unite Union members, who are looking to bring in claims for a Protective Award which would be paid out to those affected by redundancies where they have not properly been consulted.”
Ellis Kindred explains that a Protective Award is a payment awarded by an Employment Tribunal in cases where an employer fails to follow the correct procedure when making 20 or more redundancies and, where an Employment Tribunal finds in the favour of the employees, they will be able to access the funds from the UK Government Insolvency Service.
Simpson Millar’s Employment Lawyers are currently instructed by former employees affected by the collapse of Mothercare, Thomas Cook, and J Rotherham Masonry. Last year, the firm secured payments on behalf of 103 ex-Mutiyork staff amounting to £300,000.
