A Care Home Fees Refund Case Study
An elderly man was diagnosed with Alzheimer’s disease and Vascular dementia. As a result, his wife and children decided he should move into a care home, as this was the best way to ensure his complex healthcare needs would be met.
However, the family were not aware of NHS Continuing Healthcare (CHC) Funding – a free package of care for people who have significant and ongoing healthcare needs, and whose care requirements may be over and above what a Local Authority can be expected to provide.
The family therefore paid for his care home fees themselves, at a cost of tens of thousands of pounds. It was only after the elderly man passed away that the family learned about CHC Funding and that he may have been eligible.

The family contacted our team of Care Home Fees Solicitors to find out whether or not the extent of his condition could be taken into account retrospectively. After taking on the case, we carried out an investigation and helped the family put together an appeal.
An Independent Review Panel at NHS England ruled that the man would have been eligible for CHC Funding throughout his time spent living in the care home. The family’s appeal was successful, and the full costs for the man’s healthcare over a four-year period – in the region of £150,000 - are to be refunded to them.
