84 Year Old Receives Compensation From Local Council

An 84 year old pensioner who fell due to a missing drain cover suffering a large cut and bruising to his face, as well as a shoulder injury, has been awarded £6000 in compensation from his local council.Drain Cover

A Missing Drain Cover

The missing drain cover left the 12cm by 50cm drain exposed in close proximity to the bus station. Our client tripped on the open drain cover and fell, suffering a severe laceration close to his eye and bruising. He also injured his left shoulder in the fall.

He has been left with a large scar on his face and continues to need physiotherapy at Bolton Hospital to help him with his injuries.

Council's Negligence

Daxa explains, "The council showed negligence and a breach of statutory duty in failing to maintain the highway in accordance with the Highways Act 1980."

"The council initially tried to deny responsibility for this accident, and argued that it hadn't been reported prior to the accident. This was very hard to believe given the location of the missing drain cover."

The local council eventually conceded and were willing to negotiate a favourable settlement for our client once his injuries had been examined by an expert.
