£5,875 compensation awarded for occupier's liability claim


Shoulder InjurySimpson Millar recently took on a case for a client who was injured whilst his housing association carried out work to his bathroom.

The contractors for the housing association were instructed to knock through our client's bathroom and separate toilet to make one large bathroom. While the works were being carried out they left the property in an unsafe state. They had knocked the wall down but left a pipe that served the radiator in the middle of the floor.

Our client went to use the toilet after the contractors had left and tripped over the pipe and sustained a soft tissue injury to his shoulder.

Negotiations with the housing association and their contractors were particularly difficult but after a few threats of proceedings they finally agreed to deal with the occupier's liability claim and compensate our client for his personal injury.

The client was awarded £5,875 compensation.
