£4,250 awarded for fall on footpath in public liability claim
We recently acted for a lady after she injured herself during a fall on a footpath
by helping her bring a public liability personal injury claim
Our client was walking down a footpath when she fell down a dip and tripped
over a raised grate. She fractured her ankle
in her fall.
Liability was initially disputed by both the council who owned the footpath
and a communications company who owned the grate
. The communications company sought to blame another communications company for liability however it was possible to secure liability from the first
After medical evidence was obtained it was possible to secure funding for physiotherapy
which was recommended by the medical expert.
The defendant initially offered £3,500 however this was negotiated up to £4,250 plus the cost of the physiotherapy
, which was an additional £400. This offer was accepted by the client for her personal injury claim.
