More Information on Performance Management

No employer wants to be faced with a situation where their employees are under-performing.

If a situation does arise where an employee or a number of employees are under-performing, then employers will often want to take prompt and effective action to deal with this. But this must be balanced against not being too robust and potentially exposing your business to employment claims.

Where an employee is under-performing, it’s common for employers to put a performance improvement plan in place (commonly referred to as a PIP). An employee’s performance will then be assessed on a periodic basis. Employees may be given warning notices where their performance does not improve. 

However, a performance management process can become more complex where the employee’s performance is linked to a condition or disability that could be covered under the Equality Act 2010.

It can take at least 2 or 3 three months for employers to carry out an effective and fully compliant performance management process. With this in mind, employers may want to explore alternative options such as agreeing settlement terms with the employee. 

Our Employment Law Solicitors can either review your existing performance management policies or draft new policies if your company doesn’t already have a policy in place. In addition, we can advise on performance improvement plans and tackle potentially complex scenarios such as where an employee has a medical condition that impacts on their performance.
