It’s important for employers to deal with flexible working requests in the correct way. We can also advise on how best to deal with flexible working requests and return to work arrangements for employees returning from maternity leave.

Since the Flexible Working Regulations came into force in 2014, requests may be submitted by any employees, subject to meeting certain eligibility requirements.

A flexible working request could be a request to change an employee’s hours or days of work. Alternatively, an employee could also request to change their workplace location (e.g. working from home or working from an alternative office).

If an employer fails to deal with requests in the correct way, then this could increase the risk of discrimination claims. For instance, it is quite common for employees returning from maternity leave to submit a formal flexible working request. If such a request is rejected, employers are often advised to provide reasons as to why this decision was made. Ideally, this should be supported by a business case to substantiate your decision.
