Did you know?
Making a will
- Making a will gives you control over what happens
to your property after you die
- To die without making a will "intestacy". If this happens,
strict legal rules apply which decides the distribution of your property
- Often this may not reflect how you would like things done
- If you are married and have children, for instance, financial limits apply
on how much your husband or wife can receive. It could mean that they retain
the family home, but do not receive sufficient funds to afford to live there
- If you are unmarried and have a partner the
intestacy rules will not recognise that partnership
We provide advice every day to clients about making Wills. Sometimes this discussion is more difficult than at other times. An elderly lady approached our solicitors after she had been diagnosed with a terminal illness. She had a large family and wanted to leave a little to everyone. We gave advice on ensuring her disabled son was properly provided for whilst ensuring the rest of the family and particularly her grandchildren each had a small legacy.
We had several delicate conversations with the client and then quickly produced a Will which was easy to understand and which gave her complete peace of mind.

Mrs G had discovered that her elderly aunt’s neighbour was taking some of her pension money instead of buying shopping. Further enquiries revealed the neighbour had drawn thousands of pounds from her aunt’s account. We involved the police and also swiftly set up a Lasting Power of Attorney which authorized Mrs G to look after her aunt’s banking and paying the bills. Mrs G’s Aunt was very relieved that her niece was able to officially deal with everything for her.
Deputyships
A Deputy is a person appointed by the court of protection to manage the property and affairs or personal welfare of another person who lacks the mental capacity to take such decisions. Living wills
A Living Will acts as a guide to Courts, relatives and doctors
in the event of a serious health problem where your quality of
life is very poor and you cannot give instructions to the doctors.

We were contacted by Miss P when her father died. As the only child everything fell to her but she had not seen her father for many years and did not feel able to make arrangements herself. We liaised with the local council as to funeral arrangements, and went to collect Mr P’s belongings from his council flat. We obtained probate to pay all outstanding bills from Mr P’s account and passed the small amount of savings and pension left to Miss P. We kept our costs proportionate to the size of the estate and at the same time made an emotionally difficult time a little easier for Miss P.
