What do I need to prove? Can I claim
personal injury compensation?
To obtain personal injury compensation you must be able to show
that somebody else was at fault for the injuries or disease you have suffered. Although
in some cases the fault would be obvious, eg being hit by a speeding car running
a red light, others may be less so. You could have been injured in your work place
or in your own home and fault may be less obvious but you could still be able to

Our postman client made a personal injury compensation claim after injuring his
shoulder when pulling a loaded pump truck across the rear tail lift of an articulated
lorry. His employers, Royal Mail, denied all liability for the accident and the
case proceeded to a full hearing at the Mayors and City of London Court. It was
our client’s case that there was a gap between the rear body of the lorry and the
tail lift and the wheels of the pump truck became caught in this gap. Consequently,
our client hurt his shoulder as he exerted extra force to get the pump truck into
the back of the lorry.
Royal Mail defended the claim on the grounds that the manual handling task involved
did not create a foreseeable risk of injury. Moreover, they heavily relied on the
fact that, to their knowledge, no other employee had previously suffered injury
when carrying out this task. The Judge accepted our submissions that the lifting
operation involved applying a force of 27 KGs which exceeded the HSE recommended
maximum figure of 20 KGs. Our client therefore succeeded in establishing a breach
of regulation 4 of the Manual Handling Operations Regulations 1992. The judge also
found that Royal Mail had breached its common law duty to provide and maintain a
safe and suitable system of work. Our client won his case and was awarded damages
of £45,000.
