What is C-Diff

Clostridium Difficile is a spore forming bacterium which presents as one of the normal bacteria in the gut of up to 3% of healthy adults. It can cause illness when certain antibiotics disturb the balance of "normal" bacteria in the gut. Its effects can range from:

  • nothing in some cases
  • diarrhoea of varying severity
  • severe inflammation of the bowel

Other symptoms may include:

  • fever
  • loss of appetite
  • nausea, and
  • abdominal tenderness

In a small number of cases, patients have died from complicating factors arising from this type of infection.

Can I make a C.Diff compensation claim?

You can make a compensation claim if you have been affected by Clostridium Difficile from the Health Authority or Hospital Trust responsible for the provision of medical services due to their negligence.

Some people who have contracted MRSA have achieved a successful result by bringing their claims under the Control of Substances Hazardous to Health Regulations (COSHH). Therefore, there is no real reason why the above Regulations should not apply to cases of C.Diff.

If you can prove that the medical staff have failed to follow the correct infection control policies which has then resulted in you contracting Clostridium Difficile, they may incur liability for any injury it has caused you.

C.Diff compensation cases often go further than simply whether or not you contracted the infection as a consequence of negligence on the part of the Hospital Trust in the first place. For instance:

  • a negligent delay in diagnosis resulting in a delay in you getting the treatment you needed
  • your management after diagnosis, eg did you receive the right antibiotics and the right course of treatment?

Clostridium difficile compensation claims include:

  • pain and suffering
  • loss of past and future earnings
  • cost of care and assistance
  • prescription charges and medical fees
  • travelling expenses
  • out of pocket expenses

Our solicitors can help you claim compensation for all of the above and are available to discuss your potential medical negligence case with you.
