Airplane accidents
Common accidents on planes include:
- Luggage falling from overhead lockers – whiplash accident
- Hot drinks spilt – burn and scalding accidents
- Aircraft crashes and collisions
- Slipping and tripping accidents
The Montreal Convention - travel by air
The Montreal convention applies to international carriage by air eg if you suffer
an airplane accident then this convention enables you to make a compensation claim.
The Convention provides that compensation claims
for personal injury and death whilst onboard an airplane can usually
be brought in the country most favourable
to the passenger, eg a compensation claim can be pursued in the
country where the airline is based or flying to, or the country where the injured
passenger lives.
Time limits for making an airplane accident compensation claim
It is important to know whether or not the Montreal Convention applies if you are
involved in an aircraft accident. The Montreal Convention only
allows an injured person 2 years in which to make a claim for
compensation – it also places limits on the amount of compensation
that can be claimed for personal injury and death.
Your legal rights
The Convention does operate in favour
of aircraft passengers. It imposes a strict liability on the air carrier.
This means that it is not always necessary to prove
that someone was at fault – the fact that an accident happened
is often sufficient.
