Compensation for an Accident Abroad
When you book a package holiday your tour operator is legally responsible
for you and your family’s health and safety.
If you sustain an injury at your hotel or on-board your
aircraft or coach hotel transfer your tour operator could be liable and
consequently you could be entitled to claim substantial compensation.
The law permits you 3 years to claim compensation from the date
of your accident and in the case of children the 3 years begin from the date a child
attains the age of 18 years.
There are exceptions. If your personal injury happened on an airplane or
cruise ship the time limit may only be 2 years from the
date of your accident.
When you make a personal injury accident claim you can claim back all the money
your accident has cost to you such as the cost of your spoilt holiday and any wages
you may have lost.
You can also claim a lump sum for your personal injury which is for your ‘pain and
suffering’.
In 2011 examples of typical pain and suffering compensation awards are:
- Up to £5,150 for a minor back injury where a recovery has been
made in less than 2 years with no surgery required
- £8,250 to £16,100 for a wrist injury that leaves some permanent
disability such as stiffness and persisting pain
- £2,850 to £5,150 for a soft tissue injury to the shoulder which
is painful but a full recovery is made in less than 2 years
