What are Care Proceedings/Public Children Matters?
'Care proceedings' is the legal term used to describe family cases involving a Local Authority and are also known
as 'public children' matters. The main focus within these proceedings is the welfare of the child
and the Court will always consider what is in the best interests
of the child. This area of law relates to the Children Act 1989.
How can we help you?
We offer legal advice and representation by a Team of 4 Expert Panel Solicitors,
who are placed to deal with all aspects of care proceedings, working
constructively with Local Authorities, Guardians and bodies such as CAFCASS.
We are attuned to the sensitive and often emotive nature of such work, and understand.
Things that can happen when your child is taken into care
We are able to deal with the full range of matters in the Family Proceedings Court,
- Care Orders - ie when parental responsibility changes
- Supervision Orders ie these orders place the child under the supervision of the local authority
- Emergency Protection Orders - ie when a child is in danger and needs a place of safety, and
- Placement Orders, including interim Orders and applications made on an urgent basis - ie refers to placing a child for adoption or temporary care
We can also deal with more ‘niche’ issues such as changing a child’s name and proceedings
where the permanent relocation of a child is in dispute.
We deal with all aspects of your case, from initial advice through
to representation at Court hearings. Our work includes Case Conferences,
Advocates Meetings and Reviews.
Can I have a face-to-face appointment?
The Team is able to arrange face to face appointments, and can
also be contacted via telephone and email. We are able to offer continuity of solicitor
throughout a matter, so you have a sole point of contact at all times.
Why do I need a Care Proceeding Solicitor?
First and foremost, the Court will require each party in the proceedings to
be represented. It is also important to obtain professional advice
from the outset, given the nature of care proceedings and the pace with which matters
Specialist advice and assistance can help to minimise the stress and uncertainty
involved when your child is taken into care. It allows you to be fully informed at all times and to work confidently
with your solicitor in taking the right course of action for your child.
Why choose us?
We have an established reputation in this area, reinforced by our
standing as a national firm.
We appreciate how daunting the process can be for those involved. We recognise that
care matters cannot be dealt with by a 'one size fits all' approach and adopt a
personalised, considered view to each case. Dealing with the fast-moving nature
of care proceedings and their complexities can be difficult, and we are able to
guide clients through the process step-by-step.
