What are Care Proceedings/Public Children Matters?

'Care proceedings' is the legal term used to describe family cases involving a Local Authority and are also known as 'public children' matters. The main focus within these proceedings is the welfare of the child and the Court will always consider what is in the best interests of the child. This area of law relates to the Children Act 1989.

Things that can happen when your child is taken into care

  • Care Orders - ie when parental responsibility changes
  • Supervision Orders ie these orders place the child under the supervision of the local authority
  • Emergency Protection Orders - ie when a child is in danger and needs a place of safety, and
  • Placement Orders, including interim Orders and applications made on an urgent basis - ie refers to placing a child for adoption or temporary care
