Court of Protection
The Court of Protection is a specialist court which deals with matters relating
to anyone who lacks the capacity to make their own decisions. The Court of Protection
can make decisions about your property, your finances or your personal welfare.
If it is decided that you are unable to make your own rational decisions then the
Court of Protection can step in and make decisions on your behalf. Its various powers
include:
- deciding if you have the capacity to make a decision for yourself
- making decisions and orders regarding your finances and welfare
- appointing a Deputy to make all future decisions for you regarding your health and
wealth
- ruling if a lasting Power of Attorney or enduring Power of Attorney is valid
- removing Deputies or attorneys who fail in carrying out their duties
When would I need to apply to the Court of Protection?
There are times when you may need to apply to the Court of Protection, such as objecting
to the registration of a Power of Attorney and applications for Deputyships.
