Shared ownership package features
Independent Financial Advice
Not many firms of solicitors have their own in house Independent Financial Services
department. Luckily Simpson Millar LLP is one of them that does. Our financial advisors
can offer you independent financial advice on a whole range of subjects in an effort
to improve the wealth of you and your family member or friend. Another benefit of
co-buying is that as a pair you can borrow more by combining your annual salaries.
You will require mortgage advice to find out how much you and your co-buyer can
borrow, you may also want to find out about mortgage payment protection insurance
and life insurance. Here at Simpson Millar LLP we can give you independent advice
on all of this, which is included in our low cost package.

Whether you are buying with a friend, a family member or with someone you have met
through a co-buying website or scheme, a Declaration of Trust is necessary to set
the shares and act as a co-habitation agreement. A document like this will help
in the instance of potential disputes and will also set down what will be done in
the possible event of someone not paying the mortgage, deciding to move out or have
someone else move in.
As a co-buyer, you do not want to run the risk of being left to pay the mortgage
alone or face repossession. At Simpson Millar LLP we will draw up these contracts
for you to avoid any unnecessary difficulties down the line. With your help, we
will draft comprehensive legal agreements to regulate the ownership of the property.
These agreements will set out things such as:
- Who will pay the mortgage and bills
- Who will pay maintenance on the property
- What will happen if one person leaves or cannot afford their share of the mortgage
- Who will pay for home improvement costs
Each Declaration is tailored to suit the co-owner’s particular needs and circumstances,
you call the shots; we just make everything legal and provide clear advice throughout.
You should also consider writing or reviewing a will when purchasing property which
is something we can also assist you with.
