The Legal Process of Buying your Home
Residential Conveyancing Process - Stage 1
- Upon acceptance of the offer, we will contact the seller's solicitor to obtain the draft contract
- Negotiation of the draft contact will then take place
- We will make pre-contract enquiries
- We will receive a copy of the draft contract; fixtures, fittings and contents form; a property information form and if applicable copies of previous title deeds for us to check and approve
- We will then obtain local searches, check title, contract and papers and raise any queries
- Local Authority Searches
- Enquiries to seller's solicitors eg disputes, boundaries, planning constraints and permissions, rights of way, restrictive covenants, guarantees or insurance policies, services, list of contents included in the sale, check if leasehold and obtain relevant information
- Other searches eg water or coal mining
- There could be further checks we will need to make on your behalf if it is a new build property
- The Contract is negotiated and agreed and a completion date is set
- You will now need a formal mortgage offer (not just an agreement in principle)

Residential Conveyancing Process Stage 2
- Contracts are exchanged and a deposit will be required
- A transfer document will be produced and sent to the seller's solicitors
- Upon agreement of the transfer document both you and the seller will need to sign it
- We will then arrange finalisation eg signing of mortgage documents; arranging for the money to be available on the completion date
- We will carry out final searches and enquiries eg Land registry checks and Land charges checks etc
- You must pay Land registry fess and stamp duty prior to completion
Residential Conveyancing Process - Stage 3
- Completion day - we transfer the balance of the money to the seller's solicitor
- You get the keys to your new home
- We will tie up any final administration issues
