The Law Of... claiming against negligent tour operators

Our travel law specialists have helped many holidaymakers to claim compensation for their ruined holiday, and as a result of this we find that we encounter some hotels over and over again.

The Law Of... claiming against negligent tour operators

One such hotel is the Sensimar Seaside Suites and Spa resort in Riviera Maya, Mexico, where we are currently representing an increasing number of British tourists who have fallen victim to a nasty sickness bug.

Seaside Suites in Riviera Maya

Formerly known as the El Dorado Seaside Suites, the Sensimar Seaside Suites and Spa is featured by TUI owned tour operators First Choice and Thomson Holidays and is a popular destination with honeymooners, being located on the Caribbean coastline of Mexico. The resort offers an all-inclusive gourmet dining experience to holidaymakers.

Unfortunately, it appears that continuing problems at the Sensimar Seaside Suites are causing some guests to suffer a gastric illness.

Sickness Bug Causes Vomiting

Guests who have suffered illness at the Mexican hotel have complained that they have experienced debilitating symptoms ranging from severe diarrhoea to painful stomach cramps and in some cases vomiting.

This is believed to have been caused by a holiday bug that the Sensimar Seaside Suites have yet to effectively processes prevent from spreading further.

If you have suffered symptoms such as these for more than 24 hours and are returning home ill, it's imperative that you speak to your GP, as your condition may be contagious and could prove to be harmful to anyone who has close contact with you, particularly the elderly or very young children.

Historic Problems

In the past we have helped clients to claim compensation following illness at the Sensimar Seaside Suites, where previously our travel law specialists have represented a large group of holidaymakers who have proceeded to claim substantial compensation from their tour operator.

In May 2015 The Mirror reported about on an illness outbreak at what was then known as the Eldorado Seaside Suites in an article titled 'Mystery Illness Leaves Brits Vomiting Blood at Luxury Resort'. They reported that guests were suffering from a vomiting illness that left some unfortunate holidaymakers throwing up blood, resulting in legal action that was worth thousands against a negligent tour operator.

This highlights the problems that the Sensimar Seaside Suites appear to be experiencing, a state of affairs which is supported by the growing number of angry people whose holiday has been ravaged by this sickness bug.

It is also a prime example of why it's important to pursue legal action against holiday companies who continue to send unsuspecting tourists to destinations that have historically had problems with illness.

Expert Opinion

Nick Harris, our Head of Holiday Claims at Simpson Millar Solicitors has the following to say:

"I'm keen to hear from anyone who has had a bad experience at the hotel so that I can get an understanding of the scale of the illness situation and any hygiene issues that might be the cause of guests falling sick."

"We have already been contacted by a number of guests who have suffered illness at the Sensimar Seaside Suites, and by receiving further accounts of illness we can better help those affected as we build a stronger case that will benefit all of those involved."
