Pleural Plaques victims in Scotland win the right to be heard
-
In April 2009 the Scottish Government passed the Damages (Asbestos-related Conditions) (Scotland) Act which is due to come into effect on 17 June 2009.
Since the Act was passed 4 of the largest insurance companies are looking to get the law quashed as "legislatively incompetent".
The new Act means that sufferers of pleural plaques who had previously been unable to claim compensation for this disease will now be eligible to, hence the reason the insurers are opposing the Bill in any way they can.
On 26 May 2009 the issue will be heard at the Court of Session and victims have now been given the go ahead to be represented at this session.
Hopefully this means that everyone can be fairly represented and the rights and interests of victims will be heard as well as the views of the insurance companies.
