Employee unlawfully dismissed because of pregnancy

An Employment Tribunal has held that an employee was unlawfully dismissed because of her pregnancy.

Joanne Glover, of Eastbourne, was dismissed from Express Construction Cleaning Limited when she sought to bring forward her maternity leave.

Ms Glover, a GMB member, who worked for the Company as an administrator, said, "I telephoned the Company to tell them that I would be bringing forward my maternity leave. The next thing, I was dismissed. I tried to appeal against my dismissal but the Company didn’t allow me any appeal hearing."

The Employment Tribunal, sitting in Croydon, upheld Ms Glover’s claims for discrimination on the grounds of pregnancy and maternity and unfair dismissal.

Asha Wije, solicitor and partner of Simpson Millar LLP, who brought proceedings on behalf of Ms Glover said, "the Equality Act 2010 makes it very clear that it is unlawful for an employer to discriminate against a woman because of her pregnancy or because she seeks to exercise the right to take maternity leave".

Ms Glover, who gave birth to a baby girl shortly after her dismissal said, "I am happy that my baby, Elliana, is nice and healthy and that the awful stress that I suffered because of the Company in my pregnancy didn’t affect her."

The matter will now be listed for a separate remedies hearing.
