£1,850 compensation awarded for Food Poisoning suffered in Dominican Republic

We were recently instructed by our client to assist in a group compensation claim against the UK tour operator, Thomas Cook.

Our client went on holiday to the Dominican Republic in 2011 to the Grand Paradise Playa Dorada Beach Resort. Whilst staying there, he became ill with a gastric illness. Our client was part of a group claim of 8 people that we represented, one of which was diagnosed with Campylobacter food poisoning.
There were various hygiene concerns regarding the Grand Paradise Playa Dorada Beach hotel such as birds flying around the restaurant area.
The tour operator denied liability on the basis that the hotel was safe. A medical report was obtained for our client and the other claimants in the group of 8. A gastroenterologist was instructed to provide a report for each client in which he was able to draw upon each of their experiences and form a conclusion that there was a campylobacter outbreak at the hotel.
Liability was strenuously denied by the solicitors representing Thomas Cook however once the medical report was served to them, they made offers to settle. The initial offer was too low but after some negotiation the offer was increased so that the client was fairly compensated. £1,850 was awarded to the client in relation to their holiday illness claim.
