Transcript - Wills and Probate Legal Services
Hi. I am Sian Thompson from Simpson Millar LLP Solicitors and my area of specialism
is dealing with Wills and Probate work.
In the Wills and Probate Department obviously we deal with Wills and Probate work.
The Wills can be anything from very straightforward Wills or very complex ones for
complex situations, single Wills or mirror Wills for married couples and we look
at what your individual needs are when dealing with those Wills.
We deal with all kinds of probate work eg arrangements after a bereavement. Quite
often there isn’t the need to apply for formal Probate but if you speak to us first
we can identify what is needed and assist along the way, quite often if somebody
owns a house in joint names then there is no need for Probate or if there is only
some small bank accounts, again you can claim the bank accounts and close them without
getting a formal Grant of Probate but we can give you help with each aspect, and
if Probate is needed then not only do we help with that but we can assist with all
aspects of the practical arrangements such as ensuring that there is buildings insurance,
that we can help re-direct post, notify Council Tax and utility companies and even
send a passport back to the passport office and usually all that is done under a
fixed fee where possible.
As well as Wills and Probate work in the department my specialism covers all sorts
of other areas particularly with legal concerns for the elderly. For example, setting
up Powers of Attorney. A Will deals with what happens when you die but the Power
of Attorney deals with what happens when you are still alive but if you lose mental
capacity, for example Alzheimer’s or senile dementia or actually if you are just
going abroad for a period time then you might want to appoint Attorneys to deal
with your finances. Lasting Powers of Attorney can be set up for either financial
affairs or also for personal welfare and again we discuss that with you and decide
what is best for your individual circumstances.
Another aspect that I deal with is Trust work and that is quite varied and in some
cases quite complex and we look at different types of Trusts in terms of what is
needed for you, so that might be a Will Trust, looking after a disabled child or
alternatively we deal with Personal Injury Trusts, so that if you have a personal
injury settlement then we put that settlement money into Trust and that’s not counted
when it comes to the Benefits Agency assessing means tested benefits.
