£27k Awarded for Injuries at Hotel in Gran Canaria
Simpson Millar LLP's Head of Travel Nick Harris has been praised by a client injured in a holiday accident at a hotel
in Gran Canaria.
The unfortunate holidaymaker from Norfolk sustained a broken hip after she fell
on a poorly maintained bridge, which spanned the hotel's swimming pool.
How did the Holiday Accident Occur?
The case involved Nick Harris proving that the bridge and the lighting provided by the hotel at the time of the accident fell below safety standards in Spain
and the Canary Islands.
After being awarded £27,000 for her injuries, Mrs Thomas said: "The service was efficient, professional and sensitive
to the nature of my claim. It was an excellent service with good communication."
"Mr Harris was considerate, understanding and extremely helpful – he was a patient and caring gentleman
, making me feel valued."
Client "booked package holiday"
Nick worked with a Spanish abogado (lawyer) and an architect
in the Canaries to prove that the bridge which resulted in Mrs Thomas' terrible injuries fell well below the standards of maintenance expected.
The lighting at the time of Mrs Thomas' accident was also poor, making it difficult for her to make her way in safety across the bridge.
Nick Harris explained: "While English law applied to her case because she had booked a package holiday, it was Spanish and Canarian standards of safety
that we had to measure."
"In Mrs Thomas' case, there were complicated issues we needed to resolve – standards vary from country to country we had to prove that the construction and maintenance of the bridge and the prevailing lighting failed to comply
with Spanish and Canarian safety standards."
Mrs Thomas added: "The service was exceptional and exceeded my expectations – I can see nothing that might improve what is offered".
